Procedure for filing a complaint

If you feel that anything on any of the Thinkogic websites violates your copyright or other intellectual property rights, please contact us with the following information:

  • A digital or physical signature of an individual authorized to act on behalf of the legitimate owner of the copyright or other intellectual property right alleged to be violated.
  • An explanation of the work protected by copyright or other intellectual property that you allege has been violated.
  • Recognition of the content that you believe to be violating, including information about where it is located and, if feasible, the URL of such copyrighted material;
  • Information that allows us to contact you, such as your mailing address, phone number, and email address (if available);
  • A statement from you stating that you believe in the truth that the use of the violating material in the way complained of is not authorised by the copyright or intellectual property owner, their representative, or the law;
  • A statement made under penalty of truth that the above information in your message is correct and that you are authorised to act on behalf of the legitimate owner of copyright or other intellectual property rights.

Please keep in mind that if you intentionally misrepresent that any material or action is violated, you will be held liable under India’s Copyright Act of 1957 and the Trademarks Act of 1999. Violations of these actions may result in legal consequences, including civil and criminal penalties.

Procedure for Counter-Notices

If you are a subscriber/customer and believe that material submitted by you on any of the Thinkogic blogs, newsletters, forums, etc. has been incorrectly removed please contact us with the following information:

  • Your physical or digital signature;
  • Recognition of information shared by you that has been deleted or to which access has been disabled, as well as the place where the item existed before it was deleted or access to it was disabled;
  • A declaration by you, under penalty of the false statements, that you believe honestly that the content was deleted or disabled as a consequence of an error or incorrect identification of the item to be withdrawn or disabled;
  • Your full name, address, email address, and phone number, as well as a statement stating that you consent to the jurisdiction of the National District Court for the district in which the Thinkogic address is located and that you will accept assistance of procedure from the individual who provided notification of violation or his representative.
