Thinkogic Privacy Policy

We at Thinkogic and our subsidiaries are committed to protecting your privacy. This Privacy Policy applies to the personal information and data collected by Thinkogic when you interact with our websites, products and services, and any other sites or services that link to this Privacy Policy. This includes when you:

  • Interact with us on our websites or through other channels (for example, by communicating with us or attending one of our events);
  • Use our product and services (including the Thinkogic Marketplace Services); and
  • When you use any other websites or services that link to this Privacy Policy.

This Privacy Policy describes how we collect, receive, use, store, share, transfer, and process your Data. This Privacy Policy also describes your choices and rights concerning your Personal Data, including your rights of access and correction of your Personal Data. For this Privacy Policy “Personal Data” means any information relating to an identified or identifiable individual. If you do not agree with this Privacy Policy, you should not use our websites, products, and services, or any other sites or services that link to this Privacy Policy. 

Thinkogic may collect and manage Personal Data when using our products and services, or what we may refer to as Software Services, Marketplace Services, etc. is defined in the Thinkogic Terms of Service and means all of our web-based applications, tools, and platforms that you have subscribed to under a Form or that we otherwise make available to you, and are developed, operated, and maintained by us, accessible via https://*.thinkogic.com or another designated URL, and any ancillary products and services, including website hosting, that we provide to you. Section 1. b “Information We Collect and Process When You Use the Marketplace Service”. 

We from time to time update this Privacy Policy and invite you to check it. We will post any changes to the Privacy Policy on this page, and if the changes are significant, we will offer a more noticeable notification by sending you an email notification or, if you subscribe to our Thinkogic products or services, through the Notification app in your Thinkogic account. Terms not stated in this Privacy Policy will have the same meaning as described in the Thinkogic Terms of Service.

1. What Information We Collect and Process

a. Information You Provide to Thinkogic

When you engage with us through our websites or any other sites or services that connect to this Privacy Policy (such as marketplace.thinkogic.com), or when you use the Software Services, we may collect Personal Data and other information from you, as explained below.

When You Visit Our Websites

We gather Personal Data from you when you fill out website forms or interact with our websites, such as subscribing to a Thinkogic blog, signing up for a webinar, subscribing to one of our services, or contacting customer support. We may request your email address, first and last name, job title, and other relevant business information. You are welcome to browse some of our websites without entering any personal information about yourself.

When you register for a Thinkogic event, we gather your name, address, phone number, and email address. We use this information to contact you and, under specific scenarios, to help you register. Additionally, we may share your registration information with our partners for future Thinkogic events.

Account and User Information

We gather Personal Data when you register for a Thinkogic account, create or edit user information, create preferences, or submit any other information required to access or use our Software Services.

Payment Information

When you sign up for paid products or services, we gather payment and invoice information. For example, we may request that you provide a billing address or billing contact for your Thinkogic account. If you provide us with payment information, we will use it only as authorized by you and our Privacy Policy.

When purchasing products or services, you may also be asked to give payment information, such as a credit card or bank account number. We manage payment processing through safe third-party payment service providers, and payments are collected via a secure payment process.

Customer Testimonials

We publish client testimonials and comments on our websites, which may include Personal Data. Before displaying a client’s name or testimonial, we get their approval by email or other agreements between the client and Thinkogic.

b. Information We Collect and Process When You Use the Marketplace Service

Usage Data 

We gather usage data when you engage with a product or service through your Thinkogic account. Usage data comprises metrics and information about how you use and interact with the Service, such as which product features you use the most when you open and close tickets, and how frequently specific features (such as procedures) are activated in your account. 

We leverage third-party providers to collect usage details. For more information on how we secure your information with these service providers, please see Section 3 “How We Share Personal Data.”

Mobile

When you access or use the Products or Software Services through our mobile applications, we automatically gather information such as your device model and version, operating system, and device identifiers.

Third-Party Integrations

You may link third-party integrations to your Thinkogic account, which may require certain rights to view data or transmit information to it. You are responsible for reviewing any third-party integrations that you authorize. We may gather information on what types of integrations you apply with your Thinkogic account.

Any permission(s) granted by you give these third parties access to your data, which may include (but is not limited to) allowing third-party apps to see, store, and edit your Thinkogic account information. We are not responsible for the practices of third-party integrations, therefore please carefully consider the rights you allow to third-party applications.

Additional Limits on the Use of Your Google User Data

Google Calendar Integration

The Service will have access to both your Google Calendar and any other calendars you use through Google to run our Appointments functionality and allow you to link those events with contacts in your Thinkogic account. Thinkogic will allow you to create and modify your calendars, as well as update individual calendar events.

Google Drive Integration

When you link your Google Drive, Thinkogic will be able to see your files, upload and download them, and save file contents and labels.

c. Information We Collect From Other Sources

Thinkogic Partners

We may also gather information about you as part of our collaborative marketing partnerships. For example, you may register for a webinar or download a white paper created by Thinkogic and a Thinkogic collaborative marketing partner. For more information on how we share data with our partners, please see the “Partners” aspect of this privacy policy’s “How We Share Personal Data” section.

Third Parties

We may get information from third-party service providers, connected organizations, and our business and solution partners.

Personal Data from Different Sources

We may combine the personal information we gather from you with personal information we receive from third-party business information providers and publicly available sources (such as social media platforms). This might include physical locations, work titles, email addresses, phone numbers, IP addresses, and social media accounts. This allows us to update and enhance our records, identify new customers, provide specific advertising, recommend items and services that may interest you, send personalized emails, and promote events. The gathering of your Data by these other third-party providers is regulated by their privacy policies.

Log Files

We, like other websites and technological services offered over the Internet, automatically collect and store information about your computer hardware and software when you visit our websites, use our products and services, or visit other sites or services linked to this Privacy Policy. This information may include your IP address, browser type, domain name, internet service provider (ISP), and the files viewed on our or our customers’ websites (if those websites are hosted on Thinkogic servers e.g., HTML pages, visuals, etc.), your operating system, duration of visit, and referring website addresses. 

When you use the Marketplace Services, we gather and keep the following types of information in logs, depending on the customer’s implementation settings:

  • When a Thinkogic user connects to their account and utilizes tools on the Thinkogic Platform,
  • When an individual visits a customer’s website, whether Thinkogic hosts the website; or
  • When an individual visits a client’s website, we determine if the website is self-hosted, whether the customer uses our plug-ins, and whether the customer relies on Thinkogic scripts and content (such as integrated forms).

Our websites may have features and widgets (such as a share and/or “like” button or active mini-programs) that run on them. These features may gather your IP address and the page you are now browsing on our sites, as well as establish a cookie to ensure that the feature functions correctly. These features and widgets are either hosted by a third party or hosted on our websites. This Privacy Policy does not cover these functionalities. Your interactions with these features are controlled by the privacy and other rules of the companies that provide them.

2. How We Use Personal Data

a. To Communicate with You About the Product and Services

We make use of the account information you submit to Thinkogic when registering for Marketplace Services to send you transactional emails or in-app notifications regarding billing, account management, and other administrative issues. We may also send you updates on our Terms of Service or other legal agreements, as well as notify you of security problems by email or in-app notice. 

We use your information to provide customer support, such as troubleshooting technical difficulties and investigating product breakdowns or vulnerabilities.

If you use the Thinkogic mobile applications, we may send you push notifications from time to time to keep you informed about events and promotions. If you no longer want to receive these signals, you can disable them at the device level.

b. To Provide the Marketplace Services

We use your account information and Personal Data to deliver the product and services to you. For example, we create your user account with the email address you provided when joining up for the marketplace, and we use your payment information to process payments for paid usage of the Marketplace Services. We also use this information to verify your identity when you log in and to give customer support.

c. To Improve and Develop Our Product and Services

We gather data on how you use our products and services. We use this information to better our products and services. For example, we use usage data to examine patterns and use throughout the platform, allowing us to decide whether new features, integrations, products, or services our consumers might be interested in.

d. To Secure and Protect our Product and Thinkogic Users

We use your account information to investigate and minimize security problems. We may also use personal information to fulfill legal requirements. We use your information to validate user accounts and sign-ups for new products, as well as to identify and prevent product misuse.

We use log files to offer wide-ranging information on how you use our websites, such as what country you are logging in from, and to assist enhance the navigation experience. Your IP addresses are also gathered and logged for security and debugging purposes, such as monitoring usage patterns and monitoring security events and occurrences. For these purposes, we link the automatically gathered data to additional personal information you submit, such as your name, email address, address, and phone number.

e. To Market and Promote the Marketplace Services

We use the information you provide to Thinkogic to sell and promote its products, services, and other offers. For example, we use the information, such as your email or physical address, to send you information or Thinkogic content that we believe would be of interest to you via post, email, or other methods, as well as marketing messages about our business.

You can opt out of receiving this promotional information by following the instructions in each message we send you, or by emailing us at privacy@thinkogic.com. If you unsubscribe from our marketing lists, we will continue to contact you about administrative issues and respond to your queries.

We can also reach you by phone for more information about further Thinkogic products or services that you may be interested in. If you have a scheduled call with a Thinkogic representative, we may record and document it. You will be informed before the call that it is being recorded, and you will be given the option to opt out of having the call recorded.

Where allowed by law, we will only send promotional materials with your permission. Otherwise, we shall sell and advertise our products and services according to our legitimate business interests.

We obtain information from third-party service providers as well as other sources, including third-party business information suppliers and publicly available sources. We may receive and use this information from these service providers and other sources, along with other information we collect through other means described in this Privacy Policy, to provide you with updates and improved Services, such as targeted communications, promotion of events, and website or product customization to improve user experience.

f. Other Purposes if We Obtain Your Consent

We share your data with third parties only if you permit us.

3. How We Share Personal Data

a. Service Providers

Personal Data may be shared with third-party service providers to help support our websites, products, and services. For example, we work with service providers for data storage, application development, marketing, sales support, and customer service. We may need to share your information with service providers to provide you with product or service information. Examples include eliminating repeated information from possibility lists, analyzing data or performing statistical analysis on your use of the Marketplace Services or interactions on our websites, providing marketing assistance, processing card payments, enhancing the information you provide us with to provide better service, developing and improving the product and services, and providing customer support or service.

b. Partners

We may share data with trusted Thinkogic partners so that they can contact you based on your request to receive these notifications, assist us with statistical analysis, give sales assistance, or provide customer service. Partners are not permitted to use your Data except for these reasons, and they must respect the confidentiality of your information.

We also work with reputable third parties to provide you with collaborative marketing essentials that we believe are beneficial to you. When you interact with these collaborative marketing partners, we will notify you of who we are sharing data with and provide a link to the collaborative marketing partner’s privacy policy so you can learn more about how to opt out of the partner’s communications.

c. Corporate Events

If Thinkogic (we or our assets) gets acquired by another entity, whether by merger, acquisition, bankruptcy, or otherwise, the new entity will obtain all of the information collected by Thinkogic on the websites and Marketplace Services. In this case, you will be notified via email and/or a clear notice on our website of any change in ownership, uses of your Personal Data, and any options you may have about your Personal Data.

d. Public Forums

Our websites may include publicly available discussion boards, blogs, and community forums (such as Thinkogic Community). Please keep in mind that any information you directly disclose on our public discussion boards, blogs, or communities (including profile information associated with the account you use to post the information) may be read, collected, and used by any member of the general public who visits these sites. Your posts and certain profile information might remain even if you delete your account. We strongly advise you to consider the sensitivity of any information you may release in this way. We will modify or delete any information you have put on the websites upon your request, as detailed in Section 5 “Your Privacy Rights and Choices” below. In exceptional circumstances, we may be unable to erase your information; if this is the case, we will notify you and explain why.

e. Compelled Disclosure

We maintain the right to use or disclose your Data as required by law or if we reasonably think that use or disclosure is necessary to defend our rights, safeguard your or others’ safety, investigate fraud, or comply with a law, court order, or legal process. If you utilize Marketplace Services, Customer Data is considered Confidential details, and you should read the Confidentiality section of the Terms of Service for more details.

4. How We Store and Secure Personal Data

a. Data Storage and Security

We utilize a wide variety of security technologies and processes to keep your data safe against unauthorized access, use, or disclosure. We store the Personal Data you give on web servers in a monitored, secure environment, free of unauthorized access, use, or exposure. All Personal Data is safeguarded by the appropriate physical, technological, and organizational barriers.

b. Retention of Personal Data

The period we maintain information on you is determined by the type of information and the method by which it is collected and stored. After a reasonable amount of time, we will either delete or remove your information; if this is not possible. we will securely keep your information and isolate it from further use until deletion is achievable.

We keep the Personal Data you send us if we have a valid business need to do so (for example, to comply with our legal requirements, settle disputes, and enforce our agreements).

When we no longer have a legitimate business need to handle your Personal Data, we securely delete or isolate it. If this is not possible, we securely maintain your Data and isolate it from further processing until deletion is achievable. We will erase this information sooner if you request it, as indicated in the “Your Privacy Rights and Choices” section below.

If you have chosen to receive marketing communications from us, we will keep information about your marketing preferences for an acceptable amount of time from the last time you showed interest in our content, products, or services, such as when you opened an email from us or stopped using your Thinkogic account. We store information obtained from cookies and other tracking technologies for an acceptable period after it was created.

5. Your Privacy Rights and Choices

a. Personal Data Requests

You have the following data protection rights:

  • Access, Correction or Deletion. You have the right to access, correct, update, or delete your personal information.
  • Objection. You have the right to object to our processing of your Personal Data, ask us to restrict its processing, or request protection of your Personal Data.
  • Withdraw Consent. If we gathered and processed your Personal Data with your permission, you may withdraw that permission at any time. Withdrawing your consent does not affect the lawfulness of any processing we performed before your withdrawal, nor does it impact the processing of your Personal Data undertaken on legitimate processing justifications other than permission.

We do not sell personal information.

Please be aware that to secure your personal information, we may verify your identification using an approach suitable to the specific request you are making. Depending on where you live, you may be able to choose a “licensed agent” to submit requests on your behalf. We shall need licensed agents to authenticate their identity and authorization per applicable legislation. You have the right to exercise the rights stated above without discrimination.

We will respond to your request to modify, correct, or delete your data promptly and notify you of the action we have taken. In certain cases, your rights may be limited, such as if granting your request could compromise the rights of others, our ability to offer the service you have requested, or our ability to comply with our legal duties and enforce our rights.

b. Anti-Spam Policy

Our Policy applies to both us and our customers and, among other things, prohibits the use of Marketplace Services to send unsolicited commercial emails in violation of applicable laws, as well as the inclusion of an “opt-out” mechanism and other required information in every email sent via the Marketplace Services. We need all of our customers to agree to follow the Policies at all times, and any breaches by a customer may result in the immediate suspension or termination of Marketplace Services.

c. To Unsubscribe From Our Communications

You may unsubscribe from our marketing communications through one of the following methods:

  • by clicking on the “unsubscribe” link located at the bottom of our e-mails;
  • updating your communication preferences by emailing us at privacy@thinkogic.com;
  • for all Thinkogic services write to us by mail at Thinkogic, 101, C Wing, Poonam Valley, Pleasant Park, Mira Road East, Thane, Maharashtra, India – 401107, Attn: Privacy and Data Protection.

Customers cannot opt out of receiving transactional communications regarding their account with us or the Marketplace Services.

6. California Privacy Rights

a. Applicability

This section applies only to California consumers. For purposes of this section “Personal Information” has the meaning given in the California Consumer Privacy Act (“CCPA”). It describes how we collect, use, and share California consumers’ Personal Information in our role as a business, and the rights applicable to such residents. The California Consumer Privacy Act (“CCPA”) requires businesses to disclose whether they sell Personal Information. Thinkogic is a business and does not sell Personal Information. We may share Personal Information with authorized service providers or business partners who have agreed to our contractual limitations as to their retention, use, and disclosure of such Personal Information. 

If you are unable to access this Privacy Policy due to a disability or any physical or mental impairment, please contact us and we will arrange to supply you with the information you need in an alternative format that you can access.

b. How We Collect, Use, and Share your Personal Information

We have collected the following statutory categories of Personal Information in the past twelve (12) months:

  • Identifiers, such as name, e-mail address, mailing address, and phone number. We collect this information directly from you or third-party sources.
  • Commercial information, such as service records. We collect this information directly from you. 
  • Internet or network information, such as browsing and search history. We collect this information directly from your device. 
  • Geolocation data, such as IP address. We collect this information from your device.
  • Financial information, such as Payment Information or financial account numbers in the process of providing you with a subscription. We collect this information from you. 
  • Inferences. 
  • Other Personal Information, in instances when you interact with us online, by phone, or by mail in the context of receiving help through our help desks or other support channels; participation in customer surveys or contests; or in providing the Marketplace Services. 

The business and commercial purposes for which we collect this information are described in Section 2 of this Privacy Policy. The categories of third parties to whom we “disclose” this information for business purposes are described in Section 3 of this Privacy Policy. The time for which we retain this information is described in Section 5 of this Privacy Policy.

c. Your California Rights

You have certain rights regarding the Personal Information we collect or maintain about you. Please note these rights are not absolute, and there may be cases when we decline your request as permitted by law.

The right of access means that you have the right to request that we disclose what Personal Information we have collected, used, and disclosed about you in the past 12 months. 

The right of deletion means that you have the right to request that we delete Personal Information collected or maintained by us, subject to certain exceptions. 

The right to correction means that you have the right to request that we correct any inaccurate personal information that we maintain about you.

The right to non-discrimination means that you will not receive any discriminatory treatment when you exercise one of your privacy rights. 

Thinkogic does not sell or share Personal Information to third parties (under California Civil Code §§ 1798.100–1798.199, also known as the California Consumer Privacy Act of 2018).

d. How to Exercise your California Rights

You can exercise your rights yourself or you can alternatively designate an authorized agent to exercise these rights on your behalf. Please note that to protect your Personal Information, we will verify your identity by a method appropriate to the type of request you are making. We may also request that your authorized agent have written permission from you to make requests on your behalf, and we may also need to verify your authorized agent’s identity to protect your Personal Information.
